1. Sexual Violence Policy
Elite Truck Driving Academy is committed to providing its students with an educational environment free from sexual violence and treating its students who report incidents of sexual violence with dignity and respect.
Elite Truck Driving Academy has adopted this Sexual Violence Policy, which defines sexual violence and outlines its training, reporting, investigative, and disciplinary responses to complaints of sexual violence made by its students that have occurred on its campus, or at one of its events and involve its students.
The person accused of engaging in sexual violence will be referred to as the “Respondent”, and the person making the allegation as the “Complainant.”
2. Definition of Sexual Violence
Sexual violence means any sexual act or act targeting a person’s sexuality, gender identity, or gender expression, whether the act is physical or psychological in nature, that is committed, threatened, or attempted against a person without the person’s consent.
This includes, but is not limited to:
Sexual assault
Sexual harassment
Stalking
Indecent exposure
Voyeurism
Sexual exploitation
3. Training, Reporting, and Responding to Sexual Violence
Elite Truck Driving Academy will:
Include a copy of the Sexual Violence Policy in every student contract.
Provide a copy of the Policy to career college management, instructors, staff, other employees, and contractors.
Train all parties on the policy and its processes for reporting, investigating, and responding to complaints of sexual violence involving students.
Any company offering student internships must provide written confirmation that it complies with all applicable legislation, including the Ontario Human Rights Code and the Occupational Health and Safety Act, and must give students access to related policies if sexual violence issues arise.
The Sexual Violence Policy will be published on the school website (or, where no website exists, in a visible location on campus).

All staff, instructors, and contractors must report incidents or complaints of sexual violence to:

Confidentiality
Elite Truck Driving Academy will make every reasonable effort to keep personal information confidential, except when:
There is an imminent risk of self-harm or harm to others.
There are reasonable grounds to believe others may be at risk.
To protect confidentiality:
Information will only be shared with those who need to know for investigation or safety purposes.
All documentation will be kept separate from student records.
Student Rights
A Complainant has the right not to report or not to participate in an investigation.
However, the Academy may still be required by law to initiate an investigation or inform the police if community safety is at risk.
Students affected by sexual violence will receive appropriate accommodations (e.g., academic, counselling, or medical support) regardless of whether they file a formal report.
Students who report incidents in good faith will not face discipline for policy violations related to drug or alcohol use at the time of the incident.
Investigators will not ask irrelevant questions about a student’s sexual history or expression.
4. Investigating Reports of Sexual Violence
Any student may file a written report or complaint with:

Upon receiving a report, Jatinder Gill will:
Determine whether an investigation should proceed and whether the Complainant wishes to participate.
Decide who will conduct the investigation.
Assess whether the incident should be referred immediately to police.
Determine interim safety or academic measures (e.g., restricting contact between parties, modifying course access).
Investigation Process
Once initiated:
Both Complainant and Respondent may have a support person present.
The Complainant will be interviewed to gather complete details.
The Respondent will be informed of the complaint and given an opportunity to respond.
Witnesses or persons with knowledge of the incident may be interviewed.
Both parties will receive reasonable updates about the status of the investigation.
After reviewing all evidence, Jatinder Gill will:
Determine whether sexual violence occurred.
Decide what disciplinary or corrective action, if any, should follow.
5. Disciplinary Measures
If it is determined that the Respondent engaged in sexual violence, disciplinary actions may include:
Termination of employment (for instructors or staff).
Expulsion (for students).
Restrictions on access to premises or facilities.
Any other actions deemed appropriate in the circumstances.
6. Appeal
If the Complainant or Respondent disagrees with the investigation outcome, they may appeal within 10 days by writing to:

7. Making False Statements
Knowingly making a false complaint or providing false information about a sexual violence complaint is a violation of this policy.
Individuals who violate this section are subject to disciplinary or corrective action, up to and including:
Termination of employment
Expulsion of a student
8. Reprisal
Retaliation or threats of retaliation against anyone who reports, provides information, or participates in an investigation are strictly prohibited.
Violations will result in disciplinary or corrective action, up to and including termination or expulsion.
9. Review
Elite Truck Driving Academy will ensure student input is considered in the development and review of this policy.
The policy will be reviewed every three years after its implementation and amended where appropriate.
Next review date: May 31, 2025.
10. Collection of Student Data
Elite Truck Driving Academy shall collect and provide, upon request by the Superintendent of Career Colleges, all data and information required under Subsections 32.3 (8), (9), and (10) of Schedule 5 of the Ontario Career Colleges Act, 2005, as amended.
